I'm not sure. Beings that I live in Augusta, Ga, I don't believe that there is any law against essentially "having sex with your wife". I think it will take a VERY extreme case to prove that it is "rape". I think for the most part that the law will more likely take this case as one of a domestic disagreement, something along the lines of a failing marraige and then the two having sex and then the thoughts that the rape claim could be a possible statement simply to gain custody as the reason for the divorce (happens a lot, to be honest).

As far as I know, a husband can rape (id est, it is considered rape even if they are married) his wife, but it would be harder to prove. More of a 'their word versus theirs.'

Has she filed for a restraining order? That will do the job right there. However, with federal offenses against her, things get tricky. It's hard to use the law against someone when the law should technically get you as well.

But yes, sex without consent is still rape. If she has evidence of all the times he's come over, broken into their house and all that stuff, well, that guy could most certainly go to jail for quite a while.

But again, it all depends on the severity of the offenses she's already facing. Has she already been, erm, apprehended for these offenses? If so, then by all means, press charges because there's nothing to fear any more. If not, then it depends on if she would rather allow the law to deal with the guy at the expense of possibly being convicted herself of her crimes. It all depends on the severity of the crimes she's committed.

And don't you even consider going anywhere with a shotgun with intent to kill. That's premeditated murder, and will result in you receiving a death sentence.

Ok I think the rape thing happened about a month ago or so. She's done did her time for the federal offences. She's worried about her past biting her in the ass and causing her to lose Erin. She also said that she couldn't prove the rape and they wouldn't side with her because of that and of her federal offences.

I guess 2 weeks ago he left the house. You know, got the boot in the ass. He came back and got some of his shit and hit her in her ankle. I tihnk its broken or cracked or someshit if it isnt healed by now.

Then a storm happened and a tornado touched down around there and that night. She was talking to me later that night and said that the toilet seat was up like a man had used it and found her backdoor opened. Then she said she found a window open,. Then she said she thoguht she saw saw someone then the kitchen light came on. About that time she went and grabbed her aunts shot gun =). Eric was the one doing the shit and was half drunk but she made him leave when she saw him. He kept coming back a few times that night.


Then one night he didnt call his daughter and instead, came and shot painballs at the house. She called the cops but I dont think they found him.

He came to her job and in front of her boss said, "I'm not letting my daughter become a cunting whore like her mother". And well. She decked him in the mouth. lmfao

Now, at the moment, or last night, she sounded like she was ready to give in. Her own bitch ass mother, told her good that he raped her and went on saying that in the bible it said that woman belongs to a man. Thats abouty the time I woulda told her to take the bible and religion and shove it.

But meh. THanks for the answers. GUess she cant really do anything but go through with the divorce. ANd she dont want him arrested cuz of her daughter, Erin, and plus he wouldnt be able to pay child support and shit. =/
